21-year-old released from prison after Georgia court rules his 10-year sentence to be cruel and unusual punishment
According to CNN:
Genarlow Wilson, 21 leaves prison after the Georgia high court found his 10-year sentence to be cruel and unusual punishment.
Wilson, who was convicted in 2006 of having oral sex with a consenting 15-year-old girl when he was 17, was released Friday after spending more than two years behind bars.
His case prompted state legislature to change the law to make consensual conduct between minors a misdemeanor, rather than a felony, as was for Wilson’s case.
"The bad news is that his young life was so unfairly interrupted with time that no state court can recover for him," Sharpton added. "This is why the Justice Department and federal government must review state courts that willfully and almost without pause violate the civil rights of people, particularly young black men around this country."
Wilson who was an honor student, football star, and homecoming king at his high school in Georgia turned down an earlier plea bargain that would have gotten him released from prison earlier, but would have had to be registered as a sex offender.
The 4-3 ruling found his mandatory 10-year sentence for a sex felony to be cruel and unusual punishment.
