Court orders to free Genarlow Wilson
According to MSNBC, the Supreme Court of Georgia ordered Friday that a young man who has been in prison for over two years for having consensual oral sex with a teenage girl, be released because they believe he has served his time.
Genarlow Wilson was sentenced to ten years in jail and the court ruled 4-3 saying Wilson has received cruel and unusual punishment.
Wilson's lawyer, B.J. Bernstein, said she could expect him to be released Friday afternoon.
Wilson, 21, was convicted of aggravated child molestation after he was videotaped at a New Year's Eve party in 2003, receiving oral sex from a 15-year-old girl. He was 17 at the time.
According to CNN, the aggravated child molestation charge Wilson was convicted of was a felony which results to a mandatory 10-year sentence.
For the law to punish Wilson as it would an adult, with the extraordinarily harsh punishment of 10 years in prison without the possibility of probation or parole, appears to be grossly disproportionate to his crime," the majority opinion said.
The judge ruled that Wilson would not have to register as a sex offender and reduced his sentence to one year in jail.
